TERMS OF USE
This website is owned by Dance With Me Online Pty Ltd, a legally registered company based in Australia. These Terms of Use apply to all of our products, services and features.
1. LEGALITIES
1.1 Acceptance of Terms
The Terms of Use Agreement (hereinafter referred to as the "Agreement") sets forth legally binding terms for all users of the Dance With Me Online Website (hereinafter referred to as the “Website”. By using our Website, you agree to be bound by this Agreement, whether you are a "Visitor" (which means that you simply browse one or more of our Websites) or you are a "Member", either Guest or full (which means that you have registered on one of our Websites as a user). If you do not accept the terms of this Agreement you should leave our Website and discontinue use of the Service immediately. We may modify this Agreement from time to time, and such modification shall be effective upon its posting on any of our Website. You agree to be bound by any modification to this Agreement when you use any of our Website after any such modification is posted; it is therefore important that you review this Agreement regularly.
1.2 General Registration Requirements
If you wish to become a Member, communicate with other Members and otherwise make use of the Service, you must read this Agreement and by completing your payment process indicates acceptance of the Dance With Me Online’s Terms and Conditions and Liability Waiver. In consideration of your use of the Service, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of Australia or other applicable jurisdiction. You also agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the registration form available on our Website and (b) maintain and promptly update your Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Dance With Me Online Pty Ltd reserves the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof) at any time.
Content on the Website is provided to you as is for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of Dance With Me Online Pty Ltd. Dance With Me Online Pty Ltd reserves all rights not expressly granted in and to the Website and the Content.
1.3 Member Account, Password and Security
If you register on our Website, you will be required to choose a password and user name, and be asked for additional information regarding your account, such as your e-mail address. You are responsible for maintaining the confidentiality of your password and account information, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Dance With Me Online Pty Ltd of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you log out from your account at the end of each session. You may never use another Member's account without prior authorization from Dance With Me Online Pty Ltd. Dance With Me Online Pty Ltd will not be liable for any loss or damage arising from your failure to comply with this Agreement.
1.4 Proprietary Rights
All materials on the Website, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, artwork, software and other elements (collectively, "Content") are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by Dance With Me Online Pty Ltd or by third parties that have licensed or otherwise provided their material to Dance With Me Online Pty Ltd. You acknowledge and agree that all Content on the Website is made available for limited, non-commercial, personal use only. Except as specifically provided herein or elsewhere on this Website, no Content may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose, by any person or entity, without Dance With Me Online’s prior express written permission
1.5 Other Sites
Our Website may contain links to other sites owned by third parties (i.e. advertisers, affiliate partners, strategic partners, or others). We are not responsible for examining or evaluating, and we do not warrant the products or offerings of, any of these businesses or individuals, or the accuracy of the content of their website. Dance With Me Online Pty Ltd does not assume any responsibility or liability for the actions, product, and content of any such website. Before you use any third party website, you should review the applicable terms of use and policies for such website. The inclusion of a link in any of our Website does not imply our endorsement of such third party website. If you decide to access any such linked website, you do so at your own risk.
1.6 International Use
Due to the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from Australia or the country in which you reside.
1.7 Privacy Policy
Dance With Me Online Pty Ltd respects your privacy and permits you to control certain aspects of the treatment of your personal information as set forth in our Privacy Policy. A complete statement of our current privacy policy can be found in our Privacy Policy. The Privacy Policy is expressly incorporated into this Agreement by this reference.
1.8 Copyright Policy
The Content on the Website including without limitation, the text, software, scripts, graphics, photos, sounds, videos, interactive features and the like and the trademarks, service marks and logos are owned by or licensed to Dance With Me Online Pty Ltd, subject to copyright and other intellectual property rights under the law.
1.9 Term and Termination
This Agreement shall remain in full force and effect for so long as Dance With Me Online are in operation. You may terminate your membership at any time, for any reason, by following the instructions on the Website. Dance With Me Online reserves the right to terminate your account or your access to our Website immediately, with or without notice to you, and without liability to you, if Dance With Me Online Pty Ltd believes that you have breached any of the terms of this Agreement, furnished Dance With Me Online with false or misleading information, or interfered with use of the Website or the Service by others.
2. MEMBERSHIPS
2.1 Types of Memberships
Currently the website offers three (3) forms of membership types:
1. ‘Guest Member’- Those who enter the website as a guest only. They sign up only giving personal information but no payment information. They have access to their own Member’s Portal that gives archived and future Blog content to them and also limited Syllabi content of all styles and levels for free. Specifically, syllabi content provided under this membership is only a two (2) minute clip of the first video of each Level’s and styles Syllabus.
2. ‘Rental Course Member’- Paying member who pays USD$20 per individual course for a duration of 3 months and receives their own Member’s Portal. They receive immediate access upon signing up of all archived content specific and only to the course they have selected when submitting payment. From here they also get the choice to sign up to the syllabi of any of the dance styles of their choice. Level joined is decided on by individual member. Only one level of a style is allowed to be accessed at one time. This is fully included in their rental membership price, no additional charge.
3. ‘Platinum Member’- Paying member who pays USD$100 per 3 months upfront and receives their own Member’s Portal. They receive immediate access upon signing up of all archived Blog and MasterClass content plus any future Blog and MasterClass content loaded while a member. From here they can also join all 3 styles of their choice at the same time. Level joined is decided on by individual member. The styles included in the Platinum Membership are Salsa, Bachata, Bachatango with each levels syllabi fully included in their membership price, at no additional charge.

2.2 Membership Content
2.2.2 Syllabus Content
Platinum Members have access to full videos of syllabus content based on their membership type. These syllabi are only accessed and chosen once in the Member’s Portal. Members make the sole decision, based on the summary provided of each level of each style, on what level they would like to join.
Members can join as many levels of a style at any given time. Within one (1) level there are 8 videos, delivered immediately. The membership is personalised to the individual member, once they enroll for that Style and Level it starts delivering the videos to the member from that moment, they join that course.
Each video will stay in the Member’s portal for the specified period of time, In which the Membership stated upon the time of signing up to the agreed membership.
Once a member has completed all 8 videos of one level, they are invited to join the next level and start the cycle again.
If a member would like to review a level already studied, he/she may do so by selecting the videos again in their library. The full 8 videos of that Level being reviewed will be available to the member all at once for the remainder of the term of the membership or rental.
2.2.3 Master Classes
Available in the Platinum Membership is access to ‘MasterClass’ videos. These videos are based on specific elements of Latin Dancing. These can include but are not limited to Ladies Styling, Shines and footwork, Spins technique, Stretches for Dancers, Dips for the Social Floor, Dips technique, Competition training etc.
When a Member joins under a course rental, they are not given instant access to any archived MasterClass videos to that point, plus any future MasterClass videos provided by Dance With Me Online during their membership. However these are available for individual rental.
Dance With Me Online will provide a minimum of one (1) new monthly Master Class video each month.
2.2.3 Blog and Tips Content
Available in ALL membership types is access to the ‘Blogs and Tips’ page of the Members Portal.
When a Member joins under any of the membership types, they are given instant access to any archived Blog/Tips content, including both video and written content, plus any future Blog/Tips content provided by Dance With Me Online during their membership.
2.2.4 Interactive Features
Dance With Me Online permits a Member to comment on any of the video content on the website. These comments are either (1) aimed at asking Dance With Me Online and its instructors questions specific to the content in that particular video, (2) aimed at asking another member questions specific to the content in that video, or (3) answering or responding to a question/comment already posted.
These comments will be expressly monitored often and feedback/responses given where necessary.
All and any comments previously posted prior to a Member joining the Website will be available to that Member during the term of their membership and while the videos are available for viewing by that Member.
2.3 Membership Terms Of Use
All memberships require a certain amount of personal information to be collected and stored. Please see our Privacy Policy on how we protect this personal information obtained.
All members get use of the sight dependent on their membership type. Please see 2.1 Types of Memberships for further details.
2.3.1 Sharing of Membership Accounts
Members of Dance With Me Online may not share, give or sell their password or username to any other person or entity. Excessive viewings or logins by any Member will be construed by Dance With Me Online Pty Ltd as fraudulent use of the Website, which will result in the immediate cancellation of membership. When becoming a Member you agree to take all actions possible to protect your username and password from fraudulent use.
2.3.2 Third Party Submissions
By posting a comment on any video on the Website the Member grants Dance With Me Online non-exclusive, fully paid, royalty free, worldwide license to use, copy, modify, adapt, translate, publish, store, reproduce, distribute, and otherwise make available such content and comments provided without prior notification, compensation, or attribution to you, and without the Member’s consent.
You may contact us to request the removal of certain content you have posted, but Dance With Me Online has no obligation to remove any such content, may choose whether or not to do so in its sole discretion, and makes no guarantee as to the complete deletion of any such content and copies thereof.
A member agrees that they will not post any comments/content that is in any way offensive or promotes racism, bigotry, hatred or physical harm; in no manner harasses another member; in no manner exploits people in a sexual or violent way; in no manner promotes information that is false or misleading; in no manner promotes illegal or criminal activities; in no manner violates any intellectual property; in no manner solicits passwords or personal identifying information from other members; in no manner involves commercial activities without prior written consent by us; in no manner contains a virus or other harmful components.
Responsibility of the content is borne solely by the Member who posts the comment. Dance With Me Online Pty Ltd is not legally liable or responsible for behavior or comments of Members. Dance With Me Online does not endorse any Third Party Submission or any opinion, recommendation.
Members acknowledge that Dance With Me Online will screen comments on the Website and has the right (but not the obligation) to edit, refuse or remove any comments or portion of for any reason we deem fit.
